The breeder guarantees the below described dog to be healthy at the time of the sale. The breeder does not assume any liability for any injuries made to puppy after delivery due to the negligence of the buyer.
The buyer agrees to have this puppy examined by a veterinarian within 5 days of delivery. If the buyer chooses not to have puppy examined within 5 days and this guarantee is not returned within 5 days of transfer of ownership, then this contract will become null and void.
The buyer must present to the breeder written verification from veterinarian as to the illness of the puppy prior to replacement. No replacement will be made until such documentation is provided. Breeder reserves the right to take said puppy to his vet for a second opinion before any replacements are made. It is the breeder's sole discretion to replace the puppy, refund the adoption price, or to do neither. The breeder is not responsible for taking said puppy back into the breeder's home for any reason, issue, or concern.
The buyer agrees that all documents that were submitted at the time of sale be returned to breeder upon return of said puppy if breeder decides to accept return of said puppy. If not returned, buyer will not receive replacement puppy.
All vet charges and expenses will be paid by the buyer. Seller will not be responsible for any vet bills incurred by buyer regardless of the issue or concern.
Breeder provides a one (1) year fatal genetic health guarantee. The fatal genetic issue HAS to reside within the dam and sire of said puppy. Should the puppy expire within the first year of ownership DUE TO A GENETIC DEFECT CAUSED BY THE BREEDER AND THE GENETIC ISSUE RESIDES WITHIN THE DAM AND SIRE, the BREEDER will have the option to replace the puppy under the following conditions:
1. Buyer agrees that should puppy expire for unknown reasons and buyer requests another puppy that an autopsy should be preformed on the puppy and a written statement is to be provided to the breeder with the exact cause of death. If the puppy expired due to the negligence of the breeder then a replacement puppy could be provided at no cost.
2. If the puppy is found to have a fatal genetic problem within the first 5 days of transfer of ownership and is due to the breeder, and the exact same genetic condition resides within the dam and sire, then a replacement puppy could be provided upon written proof from veterinarian with EXACT cause of illness.
3. Buyer agrees to return any registration papers from previous puppy to breeder before providing replacement puppy.
These fatal conditions include-severe Kidney, Heart, Pancreas, Spine and Liver conditions. Regardless of the nature or issue, the breeder is only responsible for genetic issues that reside within the dam and sire of the said puppy.
This guarantee does not include any condition that is treatable or can be medically corrected, such as coccidiosis, allergies, infections, cherry eye, underbite or overbite, any type of hernias (regardless if it's a congenital defect or not), patella issues, bacterial infections, common respiratory conditions, and like conditions that can be treated and/or corrected with medication or other means including surgery. Most conditions are caused by bacteria or other means, and it can either be treated, corrected, or it has to run its course like the common cold.
The buyer agrees to maintain the puppys health in good condition, and to provide yearly examinations, vaccinations, and any other customary procedures necessary to assure good health.
The breeder has done everything possible to produce healthy sound puppies and by raising the puppies in the best way possible in regards to diet, exercise, socialization. All necessary vaccinations and worming for the puppys age have been given, and a record of this vaccination history is supplied to buyer at time of sale.
Breeder cannot guarantee puppy to be of breeding or show quality. The breeder does not guarantee merchantability or fitness of said puppy. This health guarantee only covers fatal genetic conditions that resides within the dam and sire and is only valid within the first year of transfer of ownership of said puppy if the health guarantee has be returned to the breeder within the first 5 days of transfer of ownership
The breeder neither, makes or implies any warranties or guarantees, expresses or implied, other than those written in the agreement including, without limitation, the warranties of merchantability and fitness. This document constitutes the entire agreement between the breeder and buyer with respect to this sale. The buyers signature below confirms that they have read and understood all the conditions of the sales agreement and contract of sale.
